About Probate

The probate procedure is designed to ensure that each deceased person’s estate is properly processed. Probate begins when the deceased person’s will is validated by the court. The court will then name a personal representative for the estate. This person will be responsible for taking inventory of the estate’s assets and debts, paying off all verified debts, and distributing the assets that remain to the beneficiaries named in the will.

This process can be complicated and lengthy, especially if there is no will, or, if a will is challenged. For this reason, it is best to consult an attorney. If there is no will the process is similar, except, it must be proven who the heirs are and what share of the estate that each heir is entitled to receive.
